Vehicular access points for the proposed dwellings would exacerbate an already unsatisfactory situation.

The Parish Council objects to this application because the site is washed over by green belt.  By definition then the proposed construction of the dwellings is inappropriate, contrary to GB1 of the UDP and no very special reason has been demonstrated to justify any development.  In respect of GB2 the Parish Council does not consider the proposed development in any way constitutes the filling of a small gap bounded by existing development.

It further considers the proposal not to be in scale and character with the surrounding area.

Outline application for three storey 4 bedroom detached dwelling

The Local Planning Authority considers that the proposal would provide inadequate private amenity space for occupiers of the proposed dwelling and would result inadequate private amenity space for occupiers of the existing dwelling and is thereby contrary to Unitary Development Plan Policies GP5, BD5, N13 and N23 and to advice contained in SPG Neighbourhoods for Living.

2) The Local Planning Authority considers that the difference in ground levels with the existing dwelling would result in the existing dwelling overshadowing and overlooking the private amenity space of the proposed dwelling. In addition the proximity of the protected trees to the eastern boundary means they would be likely to overshadow the outlook of the main elevation and the private amenity space.

This would result in a loss of amenity for occupiers of the main habitable rooms as well as the amenity space and would be likely to result in pressure to fell or lop the trees, and as such would be contrary to Policies BD5, GP5, N13 and N23 of the UDP, to advice contained in SPG Neighbourhoods’ for Living and to RDA4 Distance to Trees.

3) The Local Planning Authority considers that the proposed development would be likely to lead to the loss of trees and hedging within and adjoining the site, both through root zone damage caused by extensive excavation, removal of frontage vegetation as well as pressure to fell, to the detriment of the prevailing street scene and to the character and appearance of the area, and is thereby contrary to Leeds Unitary Development Plan Policies GP5, BD5, N13, and N23, to advice contained in SPG Neighbourhoods’ for Living and RDA4 Distance to Trees. 

The Parish Council objects on the following grounds:
Inadequate provision for safe vehicular access and egress.
Overbearing design which would be detrimental to the street scene.
Poor and characterless design that is totally inappropriate for is location.

The PC feels that the development would still be unacceptable due to scale, form and detailing which would result in significant visual detriment to the character, appearance and setting of existing property and streetscene.  The car parking concerns have still not been addressed because the three proposed car parking spaces take up virtually 50% of the garden with an adverse impact on the streetscene.

LCC considers this is an inappropriate development within Green Belt and the applicant has failed to demonstrate very special circumstances to justify setting aside Green Belt policy.

LCC considers the proposal would result in the creation of an area of residential development of four units within an area of open countryside which would be detrimental to the rural character and appearance of Green Belt.

LCC considers that the proposal would represent an inappropriate development in Green Belt as the buildings proposed for conversion are not of a structural form or materials to be suitable for residential use without substantial rebuilding.

LCC considers that the existing site access has poor visibility in both directions and is unsuitable for intensification of use associated with the three proposed additional dwellings

The Parish Council considers there is no material change to the previous application and therefore objects on the following grounds:

1. This is a residential development of a small holding, effectively a change of use.

2. It is in an isolated residential development within a Green Belt location without any links to previous occupation of land –erosion of the countryside, contrary to UDP N1,N2,N33 and GP6 and VDS 3.1

3. It will set a precedent for further development of adjourning land.
